Car Crashes into Building and Kills Pedestrian

On Sunday morning, a car ran a red light and then left the roadway. The car drove over a curb and struck a pedestrian before crashing into the side of an apartment building. The car accident occurred near the intersection of Congress and La Branch. The pedestrian was taken to St. Joseph Medical Center where he passed away.

The driver of the vehicle broke his ankles in the crash and was taken to Ben Taub General Hospital. Depending upon the outcome of the investigation by the police, the district attorney might bring criminal charges against the driver. Eyewitnesses reported the collision to the police.

Even if criminal charges are not brought against the driver, he faces potential civil claims. The pedestrian’s estate and family members may bring a lawsuit against the driver for negligence, negligence per se, and gross negligence. The owner of the apartment building may also seek a claim against the driver for property damage. If the driver is uninsured, the estate may seek recovery from the pedestrian’s insurance if he had UIM coverage.
